DURHAM, NC (USA) and LIEGE (BELGIUM) ― April 5, 2006 ― OncoMethylome Sciences announced today that it will perform MGMT gene methylation testing for a multi-center clinical trial for patients with brain tumors conducted jointly by the U.S.-based Radiation Therapy Oncology Group (RTOG) and the European Organization for Research and Treatment of Cancer (EORTC). With patient enrollment underway, the trial was designed to determine whether increasing the intensity of temozolomide drug treatment regimen for patients with glioblastoma multiforme tumors improves clinical outcomes over standard-dose temozolomide. This phase III trial brings together a valuable network of international medical centers and universities and is the first such collaborative study between RTOG and EORTC organizations."

In a preliminary ruling, patent examiners said Genentech's claims represented "double-patenting," meaning the new patent, awarded in 2001, covered basically the same invention as an earlier Genentech patent that was set to expire next March.

EliseW writes "After reading up on biotechnology foods, I have to admit that all the controversy is exactly that controversial, and the only way to solve any of the problems is to meet a happy medium. The biotech corporations want to keep growing their food, backing it up saying its FDA approved and the health infused public wants to either eliminate it completely or list all genetically altered foods. Obviously both sides don’t want to give into the other. The corporations don’t want to stop making genetically altered foods for they would lose their jobs and listing genetically altered foods on the nutrition label would only scare away consumers. The public however says that the foods can be potentially detrimental to their health and it’s their right be aware if a product contains these modifications. I feel that both sides can be content by making a reference on the nutrition label that the product contains genetically altered foods and instead of listing all of the genetically altered food the corporations could just mention a website or an address where they can find more information concerning these foods. That way the consumer is aware of what they are eating and at the same time they are not scared away. "

The Economist has a nice article describing the possibilities of applying well-known open-source principles on biotech and medicine. According to the paper, it could be applied in two fields: for those drugs of which the patent has expired, and for diseases with a niche or uneconomic market (e.g. developing countries). I think it wouldn't work perfectly though.
